When is my DMV hearing deadline?

After a DUI arrest in California the officer usually hands you an Order of Suspension and Temporary License, the pink notice. According to the DMV you have 10 days following receipt of that notice to request an administrative hearing, and the notice generally lets you drive for 30 days from the date it was issued. Enter the date to see both dates.

Good to know

The calculator counts calendar days, weekends and holidays included, starting the day after you received the notice. Do not wait for the last day: request the hearing as soon as you can through the DMV Driver Safety contact listed on the notice or on dmv.ca.gov.

The temporary license only works if your California license is otherwise valid and not suspended or revoked for another reason. If the notice was mailed to you later, for example after a blood test, the dates on your notice and the advice of an attorney take precedence over this estimate.

Requesting the DMV hearing does not deal with the criminal case. The court date on your citation or release papers still applies, and the two cases have separate deadlines.

This calculator gives general information based on the rules that apply in California as of October 2026. It is not legal advice and does not replace a review of your documents by an attorney. We are not a law firm and do not give legal advice. We connect you with independent attorneys licensed in California.
